[:en]Are you living abroad with your partner and children? You may have subscribed to a health care plan that covers you in the event of accident or of a medical condition? However what steps have you taken should you pass away? Have you subscribed to a life insurance plan?

Although it is a difficult subject to broach, it is paramount to have a thorough discussion with your partner on that particular matter.

We all know how difficult losing a loved one can be, especially whilst living abroad on unfamiliar grounds.

Therefor it is important to make sure first and foremost that your partner and children will have access to savings.

How does life insurance plan work?

The primary goal of a saving plan is to save money for the future and to grow its capital.

A life insurance is a contract whereby an insurer agrees to pay a sum insured to the beneficiary of the policyholder in case he passes away. The primary purpose is to protect your family in case of death.

Even though some health insurance companies can provide life insurance riders it is recommended to use specialized life insurance companies that can provide better terms such as higher sum insured for longer terms.

If your children are 3 and 5 years old choose a contract length that covers them until adulthood or college graduation, in that case 19 and 17 years duration.

There are no specific rules, but the industry recommends a sum insured between 8 times (if you are married without children) and 12 times (married with children) your annual income.

There is a premium table which depends on age, the younger you subscribe, the better the rate will be.

Smoker vs non-smoker, the pricing for smokers can be twice as high as the pricing for non-smokers.

Medical questionnaire, a healthy person will have better ratings than one with chronic health problems or more risky health factors.

2. Why should execute a will?

Life insurance protects your family but doesn’t take away the stress and difficulties related to administrative tasks, in the aftermath of a loved one’s death.

In such event occurring in Hong Kong, when the deceased had links with France, that is to say real estate or bank accounts, the succession will be open in France by a French notary. If required, the Probate in Hong Kong will be carried out at the same time as the inheritance process in France.

In Hong Kong, the challenge stems from the fact that the Probate is a judicial procedure, carried out before the Probate Registry, a Court specialized inheritance matters.

The Probate is mandatory if you own assets in Hong Kong (bank account, real properties, shares…) requiring a transfer of ownership.

For example, you will not be able to have access to money on a bank account or proceed to a change of name on a property deed without the Grant of Probate, also called Letters of Administration, which is a kind of Court Order.

Should Probate be required, it is highly recommended to be cautious and execute a will.

We are talking about a will drafted in English, executed in Hong Kong, appointing an Executor as well as designating the law applicable to the succession. The Executor will be in charge of the Probate process, and of distributing the Estate according to the last wishes of the deceased.

The existence of a will enables to speed up of the proceedings. Failing this, the administrator of the succession will have to be identified.

France having signed and ratified the Hague Convention on conflict of laws relating to the Form of Testamentary Dispositions of October 5th1961, a will executed in Hong Kong is valid in France, subject to the testator having his habitual residence in Hong Kong at the time of the execution of the will, or at the time of the death.

Taking these steps can be a tough process but gives the opportunity to carry out an inventory of your accounts, to discuss with your partner subjects such as access to accounts various accounts and appointment of guardians for your children. Vous êtes installés à l’étranger avec votre conjoint et vos enfants. Vous avez souscrit une assurance santé qui vous couvre vous et vos proches en cas d’accident ou de maladie. Mais qu’en est-il en cas de décès ? Avez-vous souscrit une assurance décès ?

Ces sujets sont difficiles à aborder, mais cette étape de réflexion et d’échanges avec votre conjoint est indispensable.

Nous savons combien le décès d’un proche est une épreuve difficile, surtout lorsque l’on vit à l’étranger, loin de ses repères.

La souscription d’un contrat d’assurance décès est importante mais ne suffit pas.

2.Pourquoi rédiger votre testament ?

L’assurance décès met certes votre famille à l’abri du besoin, mais non des tracasseries administratives.

En cas d’un décès à Hong Kong, si vous avez des attaches avec la France, biens immobiliers ou comptes en banque, votre succession sera ouverte en France par un notaire français. Le règlement de la succession se fera en parallèle de la procédure hongkongaise si celle-ci est nécessaire.

La difficulté avec Hong Kong tient au fait que le règlement des successions se fait par la voie judiciaire. Il faut saisir le Probate Registry, une formation de la Cour de Hong Kong spécialisée en la matière.

Cette procédure, appelée Probate est indispensable à partir du moment où vous détenez des biens à Hong Kong, qu’ils soient meubles (comptes en banques, parts sociales, compte MPF) ou immeubles, nécessitant un transfert de propriété.

Concrètement : vous pouvez débloquer les sommes sur un compte en banque ou procéder au changement d’un nom sur un acte de propriété uniquement sur présentation d’une ordonnance du juge (Grant of Probate/Letters of Administration).

Dans un premier temps faites un point sur vos avoirs à Hong Kong.

Dans le cas où un Probate s’avèrerait nécessaire, il vous est recommandé d’être prévoyant et de faire un testament de votre vivant.

ATTENTION, nous parlons d’un testament rédigé en anglais à Hong Kong désignant un exécuteur testamentaire et la loi applicable à la succession. Cet exécuteur testamentaire sera est en charge de mener à bien le règlement de la succession.

L’existence d’un testament permet d’accélérer la procédure. En effet à défaut il faut déterminer la personne habilitée à gérer la succession.

La France ayant ratifié la Convention de la Haye sur les conflits de lois en matière de forme des dispositions testamentaires du 5 octobre 1961, le testament rédigé en la forme à Hong Kong est valable en France, à condition que le testateur ait été résidant habituel de Hong Kong au moment de la signature du testament ou au moment de son décès.

Nous comprenons que ces démarches sont pénibles et difficiles mais elles sont l’occasion de faire un inventaire de vos comptes, de communiquer avec votre conjoint des modalités d’accès à vos comptes, et de désigner les tuteurs de vos enfants.

Vous pouvez aussi désigner la personne en charge de l’aspect financier en cas de décès des deux parents.
